Article 126-14 of the French Code of civil procedure

When the court is seised of a preliminary question raised by an administrative court, the clerk’s office summons to the hearing, at least one month in advance and by registered letter with acknowledgement of receipt, the parties to the proceedings brought before the administrative court and invites them to constitute a lawyer, if necessary, within this period.

The summons shall specify that in the event of failure to appear the parties shall be liable to a judgment nevertheless being rendered in their absence.

Lorsque la juridiction est saisie d’une question préjudicielle soulevée par une juridiction administrative, le greffe convoque à l’audience, un mois au moins à l’avance et par lettre recommandée avec demande d’avis de réception, les parties à l’instance engagée devant la juridiction administrative et les invite à constituer, s’il y a lieu, avocat dans ce délai.

La convocation précise qu’à défaut de comparution les parties s’exposent à ce qu’un jugement soit néanmoins rendu en leur absence.
