Article 1263-1 of the French Code of civil procedure

Associations that have been duly registered for at least five years and propose, through their articles of association, to combat discrimination may bring legal actions arising from the loi n° 2008-496 du 27 mai 2008 on behalf of the victim of discrimination.

The association must prove that it has obtained the written agreement of the person concerned after bringing the following information to their attention:

1° The nature and purpose of the action envisaged;

2° The fact that the action will be conducted by the association, which will be able to exercise the remedies itself;

3° The fact that the person concerned will be able, at any time, to intervene in the proceedings initiated by the association or to terminate them.

Les associations régulièrement déclarées depuis au moins cinq ans et se proposant, par leurs statuts, de lutter contre les discriminations peuvent exercer les actions en justice qui naissent de la loi n° 2008-496 du 27 mai 2008 en faveur de la victime d’une discrimination.

L’association doit justifier avoir obtenu l’accord écrit de l’intéressé après avoir porté à sa connaissance les informations suivantes :

1° La nature et l’objet de l’action envisagée ;

2° Le fait que l’action sera conduite par l’association qui pourra exercer elle-même les voies de recours ;

3° Le fait que l’intéressé pourra, à tout moment, intervenir dans l’instance engagée par l’association ou y mettre fin.
