Article 1278 of the French Code of civil procedure

The provisions of articles R. 322-39 to R. 322-49, R. 322-59, R. 322-61, R. 322-62, R. 322-66 to R. 322-72 of the code des procédures civiles d’exécution.

However, when received by a notary, auctions may be conducted without the assistance of a lawyer.

In the case of a sale before a notary, if there is an irresponsible bid, the procedure is continued before the court. The certificate stating that the successful bidder has not fulfilled the conditions is issued by the notary. The minutes of the auction are filed with the court registry.

Sont déclarés communes au présent chapitre les dispositions des articles R. 322-39 à R. 322-49, R. 322-59, R. 322-61, R. 322-62, R. 322-66 à R. 322-72 du code des procédures civiles d’exécution.

Néanmoins, lorsqu’elles sont reçues par un notaire, les enchères peuvent être faites sans ministère d’avocat.

Dans le cas de vente devant notaire, s’il y a lieu à folle enchère, la procédure est poursuivie devant le tribunal. Le certificat constatant que l’adjudicataire n’a pas exécuté les conditions est délivré par le notaire. Le procès-verbal d’adjudication est déposé au greffe.
