Article 1279 of the French Code of civil procedure

Within ten days of the final auction, any person may make a higher bid of the tenth by complying with the formalities and deadlines set out in the provisions of articles R. 322-50 to R. 322-55 of the code of civil enforcement procedures.

In the event that the auction has taken place before a notary, the court, by the judgment validating the higher bid, refers the new auction to the same notary who proceeds in accordance with the specifications previously drawn up.

When a second auction takes place after outbidding, no further outbidding of the same property may take place.

Article 1279

Dans les dix jours qui suivent l’adjudication définitive, toute personne peut faire une surenchère du dixième en se conformant aux formalités et délais prévus par les dispositions des articles R. 322-50 à R. 322-55 du code des procédures civile d’exécution.

Dans le cas où l’adjudication a eu lieu devant notaire, le tribunal, par le jugement qui valide la surenchère, renvoie la nouvelle adjudication devant le même notaire qui procède selon le cahier des charges précédemment dressé.

Lorsqu’une seconde adjudication a lieu après surenchère, aucune autre surenchère des mêmes biens ne peut avoir lieu.
