Article 128 of the French Civil Code

The judgment declaring absence carries with it, from the time of transcription, all the effects that the established death of the absent person would have had.

The measures taken for the administration of the property of the absent person, in accordance with Chapter I of this Title cease, unless otherwise decided by the court or, failing that, by the judge who ordered them.

The spouse of the absent person may contract a new marriage.

Article 128

Le jugement déclaratif d’absence emporte, à partir de la transcription, tous les effets que le décès établi de l’absent aurait eus.

Les mesures prises pour l’administration des biens de l’absent, conformément au chapitre Ier du présent titre prennent fin, sauf décision contraire du tribunal ou, à défaut, du juge qui les a ordonnées.

Le conjoint de l’absent peut contracter un nouveau mariage.
