Article 1280 of the French Code of civil procedure

The higher bid provided for in the second paragraph of Article 459 of the Civil Code shall be made, within ten days of the auction, by petition delivered or addressed to the registry of the court within whose jurisdiction the notary who conducted the sale resides.

This petition shall be served on the person or at the domicile of the successful bidder within the period of Article 709 of the Code of Civil Procedure.

The rules of Article 1279 are, for the remainder, applicable to it.

Article 1280

La surenchère prévue par le second alinéa de l’article 459 du code civil est faite, dans les dix jours qui suivent l’adjudication, par requête remise ou adressée au greffe du tribunal dans le ressort duquel réside le notaire qui a procédé à la vente.

Cette requête est dénoncée à la personne ou au domicile de l’adjudicataire dans le délai de l’article 709 du code de procédure civile.

Les règles de l’article 1279 lui sont, pour le surplus, applicables.
