Article 1281-13 of the French Code of civil procedure

The third-party purchaser shall arrange for the notification provided for in Article 2464 of the Civil Code by bailiff’s deed, at the addresses elected by the creditors in their registrations.

He shall attach to the deed:

1° An extract of its title, containing the date and nature of the deed, the identity of the seller or donor, the nature and location of the property sold or donated, the sale price, or, if there has been a donation, the valuation of the property;

2° An extract from the publication of the deed of sale or the deed of gift;

3° A summary mortgage statement based on the formalities, showing the real charges on the property;

4° Where applicable, an extract of the entries in the register referred to in article R. 521-1 of the Commercial Code.

The creditors are notified of the deed.

Le tiers acquéreur fait procéder à la notification prévue à l’article 2464 du code civil par acte d’huissier de justice, aux domiciles élus par les créanciers dans leurs inscriptions.


Il annexe à l’acte :


1° Un extrait de son titre, contenant la date et la nature de l’acte, l’identité du vendeur ou du donateur, la nature et la situation de l’immeuble vendu ou donné, le prix de la vente, ou, s’il y eu donation, l’évaluation de l’immeuble ;


2° Un extrait de la publication de l’acte de vente ou de l’acte de donation ;


3° Un état hypothécaire sommaire sur formalités faisant apparaître les charges réelles qui grèvent l’immeuble ;


4° Le cas échéant, un extrait des inscriptions au registre mentionné à l’article R. 521-1 du code de commerce.


L’acte est notifié aux créanciers.
