Article 1287 of the French Code of civil procedure

The application referred to in the first paragraph of Article 1286 shall be investigated and judged as in non-contentious matters and shall obey the rules applicable to such proceedings before the judicial court.

However, where the application for authorisation seeks to override the spouse’s refusal, the provisions of articles 840 to 844 shall apply. The judge hears the spouse unless he or she is duly summoned and does not appear. The case is heard and judged in chambers.

Article 1287

La demande mentionnée au premier alinéa de l’article 1286 est instruite et jugée comme en matière gracieuse et obéit aux règles applicables à cette procédure devant le tribunal judiciaire.

Toutefois, lorsque la demande d’autorisation tend à passer outre au refus du conjoint, les dispositions des articles 840 à 844 sont applicables. Le juge entend le conjoint à moins que celui-ci, régulièrement cité, ne se présente pas. L’affaire est instruite et jugée en chambre du conseil.
