Article 1289-1 of the French Code of civil procedure

The spouse’s application shall be accompanied by any evidence of the spouse’s inability to express his or her wishes or by a medical certificate, if the inability is of a medical nature.

The judge may, either of his or her own motion or at the request of the parties, order any investigative measure.

At the hearing, he or she shall hear the spouse. He may, however, on medical advice, decide that there is no need for such a hearing.

La requête de l’époux est accompagnée de tous éléments de nature à établir l’impossibilité pour son conjoint de manifester sa volonté ou d’un certificat médical, si l’impossibilité est d’ordre médical.

Le juge peut, soit d’office, soit à la demande des parties, ordonner toute mesure d’instruction.

A l’audience, il entend le conjoint. Il peut toutefois, sur avis médical, décider qu’il n’y a pas lieu de procéder à cette audition.
