Article 1302-2 of the French Civil Code

A person who by mistake or under duress has paid the debt of another may bring an action for restitution against the creditor. Nevertheless this right ceases in the case where the creditor, as a result of the payment, has destroyed his title or abandoned the securities which guaranteed his claim.

Restitution may also be claimed from one whose debt has been paid by mistake.

Celui qui par erreur ou sous la contrainte a acquitté la dette d’autrui peut agir en restitution contre le créancier. Néanmoins ce droit cesse dans le cas où le créancier, par suite du paiement, a détruit son titre ou abandonné les sûretés qui garantissaient sa créance.

La restitution peut aussi être demandée à celui dont la dette a été acquittée par erreur.
