Article 1328-1 of the French Civil Code

Where the original debtor is not discharged by the creditor, the security interests survive. Otherwise, the securities granted by the original debtor or by third parties only survive with their agreement.

If the assignor is discharged, his joint and several co-debtors remain liable after deducting their share of the debt.

Lorsque le débiteur originaire n’est pas déchargé par le créancier, les sûretés subsistent. Dans le cas contraire, les sûretés consenties par le débiteur originaire ou par des tiers ne subsistent qu’avec leur accord.

Si le cédant est déchargé, ses codébiteurs solidaires restent tenus déduction faite de sa part dans la dette.
