Article 1350-2 of the French Civil Code

A remission of debt granted to the principal debtor discharges the sureties, even joint and several.

A remission granted to one of the joint and several sureties does not discharge the principal debtor, but discharges the others to the extent of its share.

What the creditor has received from a surety for the discharge of his surety bond must be set off against the debt and discharge the principal debtor in proportion. The other guarantors remain liable only after deducting the share of the discharged guarantor or the value provided if it exceeds that share.

La remise de dette accordée au débiteur principal libère les cautions, même solidaires.

La remise consentie à l’une des cautions solidaires ne libère pas le débiteur principal, mais libère les autres à concurrence de sa part.

Ce que le créancier a reçu d’une caution pour la décharge de son cautionnement doit être imputé sur la dette et décharger le débiteur principal à proportion. Les autres cautions ne restent tenues que déduction faite de la part de la caution libérée ou de la valeur fournie si elle excède cette part.
