Article 1351-1 of the French Civil Code

Where the impossibility of performance results from the loss of the thing due, the debtor put on notice is nevertheless discharged if he proves that the loss would have occurred in the same way if the obligation had been performed.

He is, however, bound to assign to his creditor the rights and actions attached to the thing.

Lorsque l’impossibilité d’exécuter résulte de la perte de la chose due, le débiteur mis en demeure est néanmoins libéré s’il prouve que la perte se serait pareillement produite si l’obligation avait été exécutée.

Il est cependant tenu de céder à son créancier les droits et actions attachés à la chose.
