Article 136 of the French Code of Criminal Procedure

Failure to comply with the formalities prescribed for appearance warrants, committal warrants, detention warrants, arrest warrants and search warrants may give rise to disciplinary sanctions against the investigating judge, the liberty and custody judge or the public prosecutor.

These provisions are extended, subject to the application of more severe penalties, where applicable, to any violation of the measures protecting individual freedom prescribed by the articles 56, 57, 59, 96, 97, 138 and 139.

In the cases referred to in the two preceding paragraphs and in all cases of infringement of personal liberty, the conflict can never be raised by the administrative authority and the courts of the judicial order always have exclusive jurisdiction.

The same applies in any civil proceedings based on facts constituting an infringement of personal freedom or the inviolability of the home provided for by the articles 432-4 to 432-6 and 432-8 of the Penal Code, whether directed against the public authority or its agents.

Article 136

L’inobservation des formalités prescrites pour les mandats de comparution, d’amener, de dépôt, d’arrêt et de recherche peut donner lieu à des sanctions disciplinaires contre le juge d’instruction, le juge des libertés et de la détention ou le procureur de la République.

Ces dispositions sont étendues, sauf application de peines plus graves, s’il y a lieu, à toute violation des mesures protectrices de la liberté individuelle prescrites par les articles 56, 57, 59, 96, 97, 138 et 139.

Dans les cas visés aux deux alinéas précédents et dans tous les cas d’atteinte à la liberté individuelle, le conflit ne peut jamais être élevé par l’autorité administrative et les tribunaux de l’ordre judiciaire sont toujours exclusivement compétents.

Il en est de même dans toute instance civile fondée sur des faits constitutifs d’une atteinte à la liberté individuelle ou à l’inviolabilité du domicile prévue par les articles 432-4 à 432-6 et 432-8 du code pénal, qu’elle soit dirigée contre la collectivité publique ou contre ses agents.
