Article 1360 of the French Civil Code

An exception is made to the rules set out in the previous article if it is materially or morally impossible to obtain a writing, if it is customary not to draw up a writing, or if the writing has been lost by force majeure.

Les règles prévues à l’article précédent reçoivent exception en cas d’impossibilité matérielle ou morale de se procurer un écrit, s’il est d’usage de ne pas établir un écrit, ou lorsque l’écrit a été perdu par force majeure.
