Article 1362 of the French Civil Code

Prima facie evidence in writing is any writing which, emanating from the person contesting an act or from the person he represents, renders probable what is alleged.

The judge may consider as equivalent to prima facie evidence in writing statements made by a party at his personal appearance, his refusal to reply or his absence at the appearance.

The mention of an authentic writing or under private signature in a public register is prima facie evidence in writing.

Constitue un commencement de preuve par écrit tout écrit qui, émanant de celui qui conteste un acte ou de celui qu’il représente, rend vraisemblable ce qui est allégué.

Peuvent être considérés par le juge comme équivalant à un commencement de preuve par écrit les déclarations faites par une partie lors de sa comparution personnelle, son refus de répondre ou son absence à la comparution.

La mention d’un écrit authentique ou sous signature privée sur un registre public vaut commencement de preuve par écrit.
