Article 1373 of the French Code of civil procedure

In the event of disagreement between the co-sharers on the draft liquidation statement drawn up by the notary, the notary shall forward to the assigned judge a report setting out the respective statements of the parties and the draft liquidation statement.

The court registry shall invite the unrepresented parties to constitute a lawyer.

The assigned judge may hear the parties or their representatives and the notary and attempt conciliation.

He reports to the court on any remaining points of disagreement.

He is, where appropriate, the pre-trial judge.

En cas de désaccord des copartageants sur le projet d’état liquidatif dressé par le notaire, ce dernier transmet au juge commis un procès-verbal reprenant les dires respectifs des parties ainsi que le projet d’état liquidatif.

Le greffe invite les parties non représentées à constituer avocat.

Le juge commis peut entendre les parties ou leurs représentants et le notaire et tenter une conciliation.

Il fait rapport au tribunal des points de désaccord subsistants.

Il est, le cas échéant, juge de la mise en état.
