Article 1375 of the French Code of civil procedure

The court rules on the points of disagreement.

It homologates the liquidation statement or refers the parties to the notary to draw up the deed recording the division.

In the event of homologation, it orders, if necessary, the drawing of lots by the same decision, either before the assigned judge or before the assigned notary.

Le tribunal statue sur les points de désaccord.

Il homologue l’état liquidatif ou renvoie les parties devant le notaire pour établir l’acte constatant le partage.

En cas d’homologation, il ordonne s’il y a lieu le tirage au sort des lots par la même décision, soit devant le juge commis, soit devant le notaire commis.
