Article 1384 of the French Civil Code

The oath may be referred by one party to the other, as a decisory matter, in order to make the judgment of the case depend on it. It may also be referred ex officio by the judge to one of the parties.

Le serment peut être déféré, à titre décisoire, par une partie à l’autre pour en faire dépendre le jugement de la cause. Il peut aussi être déféré d’office par le juge à l’une des parties.
