Article 1387-1 of the French Civil Code

When the divorce is granted, if debts or sureties have been granted by the spouses, jointly or severally, in connection with the management of a business, the court may decide to make the spouse who retains the professional assets or, failing that, the professional qualification that served as the basis for the business, bear the sole burden of such debts or sureties.

Lorsque le divorce est prononcé, si des dettes ou sûretés ont été consenties par les époux, solidairement ou séparément, dans le cadre de la gestion d’une entreprise, le tribunal judiciaire peut décider d’en faire supporter la charge exclusive au conjoint qui conserve le patrimoine professionnel ou, à défaut, la qualification professionnelle ayant servi de fondement à l’entreprise.
