Article 1390 of the French General Tax Code

I. – Recipients of the allocation de solidarité aux personnes âgées mentioned in Article L. 815-1 of the Social Security Code or the allocation supplémentaire d’invalidité mentioned in article L. 815-24 of the same code are exempt from the property tax on built-up properties for which they are liable in respect of their main home.

II. – Taxpayers who no longer benefit from the exemption provided for in I :

1° Are exempt from the property tax on built properties relating to their principal dwelling in the first and second years following the year in respect of which they last benefited from the exemption provided for in I ;

2° Benefit, for the calculation of the property tax on built-up properties relating to their main home, from a reduction in the rental value of two-thirds in the third year and one-third in the fourth year following the year in respect of which they benefited from the exemption provided for in I for the last time.

Article 1390

I. – Les titulaires de l’allocation de solidarité aux personnes âgées mentionnée à l’article L. 815-1 du code de la sécurité sociale ou de l’allocation supplémentaire d’invalidité mentionnée à l’article L. 815-24 du même code sont exonérés de la taxe foncière sur les propriétés bâties dont ils sont passibles à raison de leur habitation principale.

II. – Les contribuables qui ne bénéficient plus de l’exonération prévue au I :

1° Sont exonérés de la taxe foncière sur les propriétés bâties afférente à leur habitation principale la première et la deuxième années suivant celle au titre de laquelle ils ont bénéficié de l’exonération prévue au I pour la dernière fois ;

2° Bénéficient, pour le calcul de la taxe foncière sur les propriétés bâties afférente à leur habitation principale, d’un abattement sur la valeur locative de deux tiers la troisième année et d’un tiers la quatrième année suivant celle au titre de laquelle ils ont bénéficié de l’exonération prévue au I pour la dernière fois.
