Article 1399 of the French Civil Code

An adult under guardianship or curatorship may not enter into matrimonial agreements without being assisted in the contract by his or her guardian or curator.

Failing such assistance, the annulment of the agreements may be pursued within the year of the marriage, either by the protected person himself or herself, or by those whose consent was required, or by the guardian or curator.

However, the person in charge of the protective measure may apply to the judge for authorisation to enter into a matrimonial agreement alone, with a view to preserving the interests of the protected person.

Le majeur en tutelle ou en curatelle ne peut passer de conventions matrimoniales sans être assisté, dans le contrat, par son tuteur ou son curateur.

A défaut de cette assistance, l’annulation des conventions peut être poursuivie dans l’année du mariage, soit par la personne protégée elle-même, soit par ceux dont le consentement était requis, soit par le tuteur ou le curateur.

Toutefois, la personne en charge de la mesure de protection peut saisir le juge pour être autorisée à conclure seule une convention matrimoniale, en vue de préserver les intérêts de la personne protégée.
