Article 1418 of the French Civil Code

Where a debt has entered the community on the part of only one of the spouses, it may not be pursued against the other’s own property.

If there is joint and several liability, the debt is deemed to have entered the community on the part of both spouses.

Lorsqu’une dette est entrée en communauté du chef d’un seul des époux, elle ne peut être poursuivie sur les biens propres de l’autre.

S’il y a solidarité, la dette est réputée entrer en communauté du chef des deux époux.
