Article 1423 of the French Civil Code

A legacy made by a spouse may not exceed his or her share in the community.

If a spouse has bequeathed an item from the community, the legatee may claim it in kind only to the extent that the item, by the event of partition, falls within the lot of the testator’s heirs; if the item does not fall within the lot of those heirs, the legatee has the reward of the total value of the bequeathed item, out of the share, in the community, of the heirs of the testator spouse and out of the latter’s personal property.

Le legs fait par un époux ne peut excéder sa part dans la communauté.

Si un époux a légué un effet de la communauté, le légataire ne peut le réclamer en nature qu’autant que l’effet, par l’événement du partage, tombe dans le lot des héritiers du testateur ; si l’effet ne tombe point dans le lot de ces héritiers, le légataire a la récompense de la valeur totale de l’effet légué, sur la part, dans la communauté, des héritiers de l’époux testateur et sur les biens personnels de ce dernier.
