Article 1425-3 of the French Code of civil procedure

The application shall be made by petition lodged or addressed to the registry by the beneficiary of the obligation or by the persons mentioned in’article 764.

In addition to the information prescribed by Article 57, the application shall contain:

1° A precise indication of the nature of the obligation whose performance is sought and the basis on which it is based;

2° Where applicable, the damages that will be claimed in the event of non-performance of the injunction to do.

It shall be accompanied by supporting documents.

The limitation period and the time limits for taking action are interrupted by the registration of the application at the registry.

La demande est formée par requête déposée ou adressée au greffe par le bénéficiaire de l’obligation ou par les personnes mentionnées à l’article 764.

Outre les mentions prescrites par l’article 57, la requête contient :

1° L’indication précise de la nature de l’obligation dont l’exécution est poursuivie ainsi que le fondement de celle-ci ;

2° Eventuellement, les dommages et intérêts qui seront réclamés en cas d’inexécution de l’injonction de faire.

Elle est accompagnée des documents justificatifs.

La prescription et les délais pour agir sont interrompus par l’enregistrement au greffe de la requête.
