Article 1433 of the French Civil Code

The community owes a reward to the owner spouse whenever it has benefited from own property.

This is the case, in particular, when it has received own money or money from the sale of own property, without it having been used or reused.

If a dispute is raised, proof that the community has benefited from own property may be administered by any means, even by testimony and presumptions.

La communauté doit récompense à l’époux propriétaire toutes les fois qu’elle a tiré profit de biens propres.

Il en est ainsi, notamment, quand elle a encaissé des deniers propres ou provenant de la vente d’un propre, sans qu’il en ait été fait emploi ou remploi.

Si une contestation est élevée, la preuve que la communauté a tiré profit de biens propres peut être administrée par tous les moyens, même par témoignages et présomptions.
