Article 1440-1 of the French Code of civil procedure

In the event of refusal or silence maintained for two months from the date of the request, the president of the judicial court or, if the refusal emanates from a registrar, the president of the court with which the registrar exercises his functions, seized by petition, shall rule, the applicant being heard or called.

The appeal is lodged, investigated and judged as in non-contentious matters.

En cas de refus ou de silence gardé pendant deux mois à compter de la demande, le président du tribunal judiciaire ou, si le refus émane d’un greffier, le président de la juridiction auprès de laquelle celui-ci exerce ses fonctions, saisi par requête, statue, le demandeur entendu ou appelé.


L’appel est formé, instruit et jugé comme en matière gracieuse.
