Article 1444 of the French Civil Code

The separation of property, although pronounced in court, is null and void if proceedings to liquidate the rights of the parties have not been commenced within three months of the judgment becoming res judicata and if the final settlement has not been made within one year of the opening of the liquidation operations. The one-year time limit may be extended by the president of the court ruling on a petition.

La séparation de biens, quoique prononcée en justice, est nulle si les poursuites tendant à liquider les droits des parties n’ont pas été commencées dans les trois mois du jugement passé en force de chose jugée et si le règlement définitif n’est pas intervenu dans l’année de l’ouverture des opérations de liquidation. Le délai d’un an peut être prorogé par le président de tribunal statuant sur requête.
