Article 1447 of the French Civil Code

When the action for separation of property has been brought, the creditors may summon the spouses by lawyer-to-lawyer deed to communicate the application and supporting documents to them. They may even intervene in the proceedings to preserve their rights.

If the separation has been pronounced in fraud of their rights, they may appeal against it by way of third-party opposition, under the conditions laid down in the Code of Civil Procedure.

Quand l’action en séparation de biens a été introduite, les créanciers peuvent sommer les époux par acte d’avocat à avocat de leur communiquer la demande et les pièces justificatives. Ils peuvent même intervenir à l’instance pour la conservation de leurs droits.

Si la séparation a été prononcée en fraude de leurs droits, ils peuvent se pourvoir contre elle par voie de tierce opposition, dans les conditions prévues au code de procédure civile.
