Article 1451 of the French Civil Code

Articles 265-2 are suspended, as regards their effects, until the divorce is granted; they may not be enforced, even as between spouses, until the judgment has become res judicata.

One of the spouses may request that the divorce decree modify the agreement if the consequences of the divorce fixed by that decree call into question the bases of the liquidation and partition.

Les conventions passées en application de l’article 265-2 sont suspendues, quant à leurs effets, jusqu’au prononcé du divorce ; elles ne peuvent être exécutées, même dans les rapports entre époux, que lorsque le jugement a pris force de chose jugée.

L’un des époux peut demander que le jugement de divorce modifie la convention si les conséquences du divorce fixées par ce jugement remettent en cause les bases de la liquidation et du partage.
