Article 1473 of the French Code of civil procedure

Unless otherwise agreed, the arbitral proceedings shall also be suspended in the event of the death, impediment, abstention, resignation, challenge or removal of an arbitrator until the arbitrator appointed to replace him accepts his assignment.

The new arbitrator shall be appointed in accordance with the procedures agreed between the parties or, failing that, in accordance with those which governed the appointment of the arbitrator whom he replaces.

Article 1473

Sauf stipulation contraire, l’instance arbitrale est également suspendue en cas de décès, d’empêchement, d’abstention, de démission, de récusation ou de révocation d’un arbitre jusqu’à l’acceptation de sa mission par l’arbitre désigné en remplacement.

Le nouvel arbitre est désigné suivant les modalités convenues entre les parties ou, à défaut, suivant celles qui ont présidé à la désignation de l’arbitre qu’il remplace.
