Article 1498 of the French Civil Code

Where the spouses agree that there shall be community of movables and acquests between them, the common assets shall include, in addition to the property which would form part of them under the regime of legal community, the movable property of which the spouses had ownership or possession on the day of the marriage or which has fallen to them since then by succession or gift, unless the donor or testator has stipulated otherwise.

Those movable assets which would have formed own assets by their nature by virtue of Article 1404, under the legal regime, if they had been acquired during the community.

If one of the spouses had acquired an immovable since the marriage contract, containing a stipulation of community of movables and acquests, and before the celebration of the marriage, the immovable acquired in the interval will enter the community, unless the acquisition was made in execution of some clause of the marriage contract, in which case it would be settled according to the agreement.

Lorsque les époux conviennent qu’il y aura entre eux communauté de meubles et acquêts, l’actif commun comprend, outre les biens qui en feraient partie sous le régime de la communauté légale, les biens meubles dont les époux avaient la propriété ou la possession au jour du mariage ou qui leur sont échus depuis par succession ou libéralité, à moins que le donateur ou testateur n’ait stipulé le contraire.

Restent propres, néanmoins, ceux de ces biens meubles qui auraient formé des propres par leur nature en vertu de l’article 1404, sous le régime légal, s’ils avaient été acquis pendant la communauté.

Si l’un des époux avait acquis un immeuble depuis le contrat de mariage, contenant stipulation de communauté de meubles et acquêts, et avant la célébration du mariage, l’immeuble acquis dans cet intervalle entrera dans la communauté, à moins que l’acquisition n’ait été faite en exécution de quelque clause du contrat de mariage, auquel cas elle serait réglée suivant la convention.
