Article 15-3-2 of the French Code of Criminal Procedure

In the event of a complaint filed for an offence punishable by at least three years’ imprisonment committed by the victim’s spouse, cohabiting partner or partner bound to her by a civil solidarity pact, even when they are not cohabiting, or committed by the victim’s former spouse or cohabiting partner or by the partner who was bound to her by a civil solidarity pact, the judicial police officer or agent who receives the complaint informs the victim, orally and by handing over a document, that he or she may request or consent to benefit from the mobile electronic anti-seizure device provided for in Article 138-3 of this Code, the article 132-45-1 of the Criminal Code or article 515-11-1 of the Civil Code, which may be ordered by the competent court.

En cas de plainte déposée pour une infraction punie d’au moins trois ans d’emprisonnement commise par le conjoint de la victime, son concubin ou le partenaire lié à elle par un pacte civil de solidarité, y compris lorsqu’ils ne cohabitent pas, ou commise par l’ancien conjoint ou concubin de la victime ou par le partenaire ayant été lié à elle par un pacte civil de solidarité, l’officier ou l’agent de police judiciaire qui reçoit la plainte informe la victime, oralement et par la remise d’un document, qu’elle peut demander ou consentir à bénéficier du dispositif électronique mobile anti-rapprochement prévu à l’article 138-3 du présent code, l’article 132-45-1 du code pénal ou l’article 515-11-1 du code civil, qui est susceptible d’être ordonné par la juridiction compétente.
