Article 15-5 of the French Code of Criminal Procedure

Only staff specially and individually authorised for this purpose may consult data processing systems during an investigation or enquiry.

This special and individual authorisation may be verified at any time by a judge on his or her own initiative or at the request of an interested party.
The reality of this special and individual authorisation may be checked at any time by a magistrate, on his or her own initiative or at the request of an interested party. Failure to mention this authorisation on the various procedural documents resulting from consultation of these processing operations does not, of itself, render the proceedings null and void.

Seuls les personnels spécialement et individuellement habilités à cet effet peuvent procéder à la consultation de traitements au cours d’une enquête ou d’une instruction.


La réalité de cette habilitation spéciale et individuelle peut être contrôlée à tout moment par un magistrat, à son initiative ou à la demande d’une personne intéressée. L’absence de la mention de cette habilitation sur les différentes pièces de procédure résultant de la consultation de ces traitements n’emporte pas, par elle-même, nullité de la procédure.
