Article 1514 of the French Civil Code

The levy is a division transaction: the property levied is set off against the beneficiary spouse’s share; if its value exceeds that share, a balance is payable.

The spouses may agree that the compensation due by the levier will be set off subsidiarily against his or her rights in the predeceased spouse’s estate.

Le prélèvement est une opération de partage : les biens prélevés sont imputés sur la part de l’époux bénéficiaire ; si leur valeur excède cette part, il y a lieu au versement d’une soulte.

Les époux peuvent convenir que l’indemnité due par l’auteur du prélèvement s’imputera subsidiairement sur ses droits dans la succession de l’époux prédécédé.
