Article 1540 of the French Civil Code

When one of the spouses takes over the management of the other’s property, with the latter’s knowledge, and nevertheless without opposition on his part, he is deemed to have received a tacit mandate, covering acts of administration and management, but not acts of disposal.

This spouse is answerable to the other for his management as a mandatary. He is, however, only accountable for existing fruits; for those he may have neglected to collect or consumed fraudulently, he can only be sought within the limit of the last five years.

If one of the spouses has interfered in the management of the other’s property in defiance of an established opposition, he is liable for all the consequences of his interference, and accountable without limitation for all the fruits he has collected, neglected to collect or consumed fraudulently.

Quand l’un des époux prend en main la gestion des biens de l’autre, au su de celui-ci, et néanmoins sans opposition de sa part, il est censé avoir reçu un mandat tacite, couvrant les actes d’administration et de gérance, mais non les actes de disposition.

Cet époux répond de sa gestion envers l’autre comme un mandataire. Il n’est, cependant, comptable que des fruits existants ; pour ceux qu’il aurait négligé de percevoir ou consommés frauduleusement, il ne peut être recherché que dans la limite des cinq dernières années.

Si c’est au mépris d’une opposition constatée que l’un des époux s’est immiscé dans la gestion des biens de l’autre, il est responsable de toutes les suites de son immixtion, et comptable sans limitation de tous les fruits qu’il a perçus, négligé de percevoir ou consommés frauduleusement.
