Article 1542 of the French Civil Code

After the dissolution of the marriage by the death of one of the spouses, the division of undivided property between spouses separated by property, in all that concerns its forms, the maintenance of the indivision and the preferential allocation, the licitation of the property, the effects of the division, the guarantee and the balances, is subject to all the rules that are established in the title “Of successions” for divisions between co-heirs.

The same rules apply after divorce or legal separation. However, preferential allocation is never by right. It can always be decided that any balance due will be payable in full in cash.

Après la dissolution du mariage par le décès de l’un des conjoints, le partage des biens indivis entre époux séparés de biens, pour tout ce qui concerne ses formes, le maintien de l’indivision et l’attribution préférentielle, la licitation des biens, les effets du partage, la garantie et les soultes, est soumis à toutes les règles qui sont établies au titre ” Des successions ” pour les partages entre cohéritiers.

Les mêmes règles s’appliquent après divorce ou séparation de corps. Toutefois, l’attribution préférentielle n’est jamais de droit. Il peut toujours être décidé que la totalité de la soulte éventuellement due sera payable comptant.
