Article 1556 of the French Code of civil procedure

At the end of the conventional procedure and with the exception of applications for divorce or legal separation, which shall be decided in accordance with the provisions of Section II of Chapter V of Title I of Book III, the matter may be referred to the judge or the matter may be reinstated at the request of one of the parties, as the case may be, to homologate the agreement of the parties putting an end to the dispute or litigation in its entirety, to homologate a partial agreement of the parties and rule on the part of the litigation that persists or to rule on the entire litigation.

An application made to the judge by a party, pursuant to the first paragraph of Article 2065 of the Civil Code, for him to rule on the dispute before the end of the agreement, due to its non-performance by the other party, shall be made, investigated and judged in accordance with the rules of procedure applicable before that judge.

Article 1556

A l’issue de la procédure conventionnelle et exception faite des demandes en divorce ou en séparation de corps sur lesquelles il est statué conformément aux dispositions de la section II du chapitre V du titre Ier du livre III, le juge peut être saisi de l’affaire ou celle-ci être rétablie à la demande d’une des parties, selon le cas, pour homologuer l’accord des parties mettant fin en totalité au différend ou au litige, pour homologuer un accord partiel des parties et statuer sur la partie du litige persistant ou pour statuer sur l’entier litige.

La demande faite au juge par une partie, en application du premier alinéa de l’article 2065 du code civil, pour qu’il statue sur le litige avant le terme de la convention, du fait de son inexécution par l’autre partie, est formée, instruite et jugée conformément aux règles de procédure applicables devant ce juge.
