Article 1562 of the French Code of civil procedure

Where the dispute persists in its entirety, the judge may hear it:

– either in accordance with the rules governing the procedure applicable before him;

– or in accordance with the procedures laid down in paragraph 2;

– or on a unilateral application, which he shall decide in accordance with the rules applicable before him subject to the provisions of this paragraph.

Article 1562

Lorsque le différend persiste en totalité, le juge peut en connaître :

― soit conformément aux règles régissant la procédure applicable devant lui ;

― soit selon les modalités prévues au paragraphe 2 ;

― soit sur requête unilatérale sur laquelle il statue suivant les règles applicables devant lui sous réserve des dispositions du présent paragraphe.
