Article 1577 of the French Civil Code

The creditor spouse shall pursue recovery of his or her participation claim first against existing property and subsidiarily, starting with the most recent alienations, against the property referred to in Article 1573 which had been alienated by gift inter vivos or in fraud of the spouse’s rights.

L’époux créancier poursuit le recouvrement de sa créance de participation d’abord sur les biens existants et subsidiairement, en commençant par les aliénations les plus récentes, sur les biens mentionnés à l’article 1573 qui avaient été aliénés par donation entre vifs ou en fraude des droits du conjoint.
