Article 16-2 of the French Code of Criminal Procedure

Within one month of the explicit or implicit rejection of the request provided for in the previous article, the judicial police officer may lodge an appeal with a commission composed of three judges of the Court of Cassation holding the rank of chamber president or councillor. These magistrates are appointed annually, together with three alternates, by the bureau of the Cour de cassation.

The functions of the public prosecutor are performed by the public prosecutor’s office at the Cour de cassation.

Article 16-2

Dans le délai d’un mois à partir du rejet explicite ou implicite de la demande prévue à l’article précédent, l’officier de police judiciaire peut former un recours devant une commission composée de trois magistrats du siège de la Cour de cassation ayant le grade de président de chambre ou de conseiller. Ces magistrats sont désignés annuellement, en même temps que trois suppléants, par le bureau de la Cour de cassation.

Les fonctions du ministère public sont remplies par le parquet général près la Cour de cassation.
