Article 1601-4 of the French Civil Code

The assignment by the purchaser of the rights he holds under a sale of a building automatically substitutes the assignee in the purchaser’s obligations to the seller.

If the sale was accompanied by a mandate, this continues between the seller and the assignee.

These provisions apply to any transfer inter vivos, whether voluntary or forced, or mortis causa.

La cession par l’acquéreur des droits qu’il tient d’une vente d’immeuble à construire substitue de plein droit le cessionnaire dans les obligations de l’acquéreur envers le vendeur.

Si la vente a été assortie d’un mandat, celui-ci se poursuit entre le vendeur et le cessionnaire.

Ces dispositions s’appliquent à toute mutation entre vifs, volontaire ou forcée, ou à cause de mort.
