Article 1635 bis AA of the French General Tax Code

It is levied for the benefit of the guarantee fund for agricultural disasters in the overseas departments instituted by article L. 371-6 of the rural and maritime fishing code, an additional contribution to insurance premiums or contributions relating to insurance agreements covering exclusively or mainly damage to soil, crops, crops, buildings, and dead or live livestock assigned to agricultural holdings.

The additional contribution is based on all premiums or contributions. It is liquidated and collected according to the same rules, under the same guarantees and the same penalties as the annual tax on insurance agreements provided for in Article 991. The rate is set by the Finance Act and may not exceed 10%.

Il est perçu au profit du fonds de garantie des calamités agricoles dans les départements d’outre-mer institué par l’article L. 371-6 du code rural et de la pêche maritime, une contribution additionnelle aux primes ou cotisations d’assurance afférentes aux conventions d’assurance couvrant à titre exclusif ou principal les dommages aux sols, récoltes, cultures, bâtiments, et au cheptel mort ou vif affectés aux exploitations agricoles.

La contribution additionnelle est assise sur la totalité des primes ou cotisations. Elle est liquidée et recouvrée selon les mêmes règles, sous les mêmes garanties et les mêmes sanctions que la taxe annuelle sur les conventions d’assurance prévue à l’article 991. Son taux est fixé par la loi de finances et ne peut être supérieur à 10 %.
