I. – A conciliation commission is set up in each département, comprising:
1° A sitting magistrate, designated by order of the Minister of Justice, who acts as chairman;
2° The departmental director of public finance or his delegate;
3° Three civil servants from the general directorate of public finance with at least the rank of departmental inspector;
4° A notary appointed by the chamber or chambers of notaries of the department, or his deputy;
5° Three representatives of taxpayers, namely:
a. One full member and two alternates appointed by the territorial chamber or chambers of commerce and industry from among traders or industrialists, or former traders or industrialists, eligible to sit on the commercial courts; if this full member does not belong to the profession practised by the taxpayer whose situation is being examined, the taxpayer may request that he or she be replaced by a representative of one of the professional organisations to which he or she belongs;
b. One full member and two alternates appointed by the departmental federations of farmers’ unions in the department, from among rural landowners liable for tax on farm profits. Where there are several federations of farmers’ unions in a department, the members of the commission are appointed by the prefect, on the proposal of these federations;
c. One full member and two alternates chosen by the owners’ union chamber(s) in the department.
The representatives thus appointed must be of French nationality, at least twenty-five years old and enjoy their civil rights.
II. – A category A employee of the Directorate General of Public Finance acts as secretary and attends meetings in an advisory capacity.
III. – The non-civil servant members of the commission are appointed for one year and their term of office is renewable. They are bound by professional secrecy.
IV. – The commission meets when convened by the departmental director of public finance.
The commission deliberates validly, provided that there are at least five members present, including the chairman. In the event of a tie, the chairman shall have the casting vote.
