The late payment interest provided for in article 1727 and the increase provided for in l’article 1731 are applied:
1° For the companies mentioned in a of Article 1668 B, to the difference between, on the one hand, three quarters of the amount of the exceptional contribution on corporation tax due in respect of a financial year and, on the other hand, three quarters of the amount of this contribution estimated in respect of the same financial year serving as the basis for calculating the advance payment pursuant to the same Article 1668 B, provided that this difference is greater than 20% of the amount of the contribution and €100,000 ;
2° For the companies mentioned in b of the said Article 1668 B, to the difference between, on the one hand, 95% of the amount of the contribution mentioned in 1° of the present article and, on the other hand, 95% of the amount of this contribution estimated under the conditions mentioned in the same 1°, provided that this difference is greater than 20% of the amount of the contribution and €400,000.
However, the late payment interest and the increase mentioned in the first paragraph are not applied if the estimated amount of the contribution mentioned in 1° has been determined on the basis of the corporation tax, itself estimated on the basis of the projected income statement mentioned in article L. 232-2 of the French Commercial Code, revised within four months of the start of the second half of the financial year, before deduction of corporation tax. For the parent company of a group mentioned in Article 223 A or Article 223 A bis of this code, the projected income statement means the sum of the projected income statements of the companies that are members of the group.
