Article 179-2 of the French Code of Criminal Procedure

The investigating judge may specify in the committal order the date of the hearing before the police court or the criminal court when this date has been previously communicated to him by the public prosecutor. This order must then include the information provided for in the second to last paragraphs of article 390.

This order then exempts the prosecutor from issuing a summons pursuant to the same Article 390.

Article 179-2

Le juge d’instruction peut préciser dans l’ordonnance de renvoi la date d’audience devant le tribunal de police ou le tribunal correctionnel lorsque cette date lui a été préalablement communiquée par le procureur de la République. Cette ordonnance doit alors comporter les mentions prévues aux deuxième à dernier alinéas de l’article 390.


Cette ordonnance dispense alors le procureur de délivrer une citation en application du même article 390.
