Article 180 of the French Code of Criminal Procedure

In cases of referral, either to the police court or the criminal court, the investigating judge forwards the case file with his order to the public prosecutor. The latter is required to send it without delay to the clerk’s office of the court which must rule.

If the criminal court is seised, the public prosecutor must issue a summons to the accused for one of the next hearings, observing the time limits for summons provided for in the present code.

Dans les cas de renvoi, soit devant le tribunal de police, soit devant le tribunal correctionnel, le juge d’instruction transmet le dossier avec son ordonnance au procureur de la République. Celui-ci est tenu de l’envoyer sans retard au greffe du tribunal qui doit statuer.

Si la juridiction correctionnelle est saisie, le procureur de la République doit faire donner assignation au prévenu pour l’une des plus prochaines audiences, en observant les délais de citation prévus au présent code.
