Article 181-1 of the French Code of Criminal Procedure

If, at the end of the investigation, there are sufficient charges against the person of having committed, other than a repeat offence, a crime punishable by fifteen years or twenty years of criminal imprisonment, he or she shall be indicted by the investigating judge, in accordance with the procedures laid down in Article 181, before the departmental criminal court, unless there are one or more co-accused who do not meet the conditions set out in this paragraph.

The period of one year provided for in the eighth paragraph of article 181 is then increased to six months and only one extension may be made pursuant to the ninth paragraph of the same article 181.

Article 181-1

S’il existe, à l’issue de l’information, des charges suffisantes contre la personne d’avoir commis, hors récidive, un crime puni de quinze ans ou de vingt ans de réclusion criminelle, elle est mise en accusation par le juge d’instruction, selon les modalités prévues à l’article 181, devant la cour criminelle départementale, sauf s’il existe un ou plusieurs coaccusés ne répondant pas aux conditions prévues au présent alinéa.


Le délai d’un an prévu au huitième alinéa de l’article 181 est alors porté à six mois et il ne peut être procédé qu’à une seule prolongation en application du neuvième alinéa du même article 181.
