The co-undividaires may appoint one or more managers, chosen or not from among them. The procedures for appointing and removing the manager may be determined by a unanimous decision of the undivided co-owners.
In the absence of such an agreement, the manager chosen from among the undivided co-owners may only be removed from office by a unanimous decision of the other undivided co-owners.
The manager, who is not an undivided co-owner, may be dismissed under the conditions agreed between his principals or, failing this, by a decision taken by a majority of the undivided co-owners in number and shares. In all cases, dismissal may be ordered by the court at the request of an undivided co-owner where the manager, through his mismanagement, jeopardises the interests of the undivided co-ownership.
If the dismissed manager is an undivided co-owner, the agreement will be deemed to have been entered into for an indefinite period from the date of his dismissal.
