Article 1873-8 of the French Civil Code

Decisions that exceed the manager’s powers are taken unanimously, except for the manager, if he is himself an undivided co-owner, to exercise the remedies provided by the articles 815-4,815-5 and 815-6.

If there are incapacitated minors or adults among the undivided co-owners, the decisions referred to in the previous paragraph give rise to the application of the rules of protection provided in their favour.

It may be agreed between the undivided co-owners that in the absence of incapacitated persons certain categories of decisions will be taken other than unanimously. However, no undivided property may be alienated without the agreement of all the undivided co-owners, except in application of articles 815-4 and 815-5 above.

Les décisions qui excèdent les pouvoirs du gérant sont prises à l’unanimité, sauf au gérant, s’il est lui-même indivisaire, à exercer les recours prévus par les articles 815-4,815-5 et 815-6.

S’il existe des incapables mineurs ou majeurs parmi les indivisaires, les décisions dont il est parlé à l’alinéa précédent donnent lieu à l’application des règles de protection prévues en leur faveur.

Il peut être convenu entre les indivisaires qu’en l’absence d’incapables certaines catégories de décisions seront prises autrement qu’à l’unanimité. Toutefois, aucun immeuble indivis ne peut être aliéné sans l’accord de tous les indivisaires, si ce n’est en application des articles 815-4 et 815-5 ci-dessus.
